1. Acceptance of These Terms

These Terms of Use (“Terms”) govern your access to and use of the websites, features, and services of TripScout, Inc., doing business as “@hotel” or “athotel” (“TripScout,” “we,” “us,” or “our”), including:

  • www.tripscout.co and its subdomains, including trips.tripscout.co
  • www.athotel.com
  • Our Chrome browser extension (the “Extension”)
  • Any other websites, features, applications, widgets, or online services owned or controlled by us that link to these Terms

Together, these are the “Services.”

By accessing or using the Services, you agree to these Terms and to our Privacy Policy, which is incorporated into these Terms by reference and explains how we collect, use, and share information. If you do not agree, do not use the Services. Certain features described in these Terms may not be offered at all times.

2. Eligibility

The Services are intended for a general adult audience and are not directed to children under 16. If you are under 18, you may use the Services only with the involvement of a parent or legal guardian.

3. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised Terms on this page, and if the changes are significant, we will provide a more prominent notice. Changes take effect when posted. Your continued use of the Services after changes are posted means you accept the revised Terms.

We may also change, suspend, or discontinue any part of the Services at any time without notice or liability.

4. About the Services

The Services provide travel content, including destination guides, itineraries, recommendations, travel deals, and accommodation price comparisons, and, on athotel.com, hotel booking. When you book a flight or other travel product through a link or offer on tripscout.co or elsewhere on the Services, you book with a third-party provider under that provider’s own terms, prices, and cancellation policies, and TripScout is not a party to that transaction. Hotel bookings made on athotel.com are covered by Section 5.

5. Hotel Bookings on athotel.com

Hotel booking on athotel.com is powered by our technology partner, Nuitee, which provides hotel inventory, rates, and reservation services. TripScout is the merchant of record for bookings made on athotel.com, which means we charge your payment method for the booking. The hotel or other accommodation provider (the “Hotel”) provides the accommodation and is responsible for it.

To make a booking, you must be at least 18 and legally able to enter into a binding contract. You confirm that the information you provide is accurate and that you are authorized to use the payment method you submit. If you book for other travelers, you confirm that you are authorized to provide their information and to accept these Terms on their behalf.

Each booking is subject to the rate rules, cancellation and change policies, and Hotel policies shown to you before you complete the booking (the “Booking Terms”), which form part of these Terms. If the Booking Terms conflict with these Terms for a specific booking, the Booking Terms control for that booking. Non-refundable rates cannot be changed, canceled, or refunded except as required by law. Eligible refunds are issued to the original payment method.

The total price shown at final checkout, including the taxes and fees we collect, is the amount you will be charged. Some Hotels charge additional mandatory fees, such as resort fees or local taxes, that are payable at the property; we show these when that information is provided to us. Amounts shown in a currency other than the one your payment method uses are estimates, and your bank may charge conversion or foreign transaction fees.

A booking is confirmed only when you receive a confirmation email from us. If a booking cannot be confirmed, if the price or rate was displayed in error, or if we reasonably suspect fraud or misuse, we may cancel the booking and refund any amount we charged.

Hotels are independent businesses and are not our agents. We are not responsible for a Hotel’s acts, omissions, facilities, or services, including overbooking or changes to amenities, but we will help you contact the Hotel and seek a resolution. For help with a booking, contact [email protected]. Please contact us before disputing a charge with your bank so we can try to resolve the issue.

6. Travel Information, Prices, and Deals

Travel information changes often. Prices, fares, availability, schedules, opening hours, and other details shown on the Services, including price comparisons shown by the Extension, may come from third parties, may be indicative rather than live, may not include all taxes and fees, and may have changed by the time you see them. Except for the final checkout price of a booking on athotel.com (see Section 5), we do not guarantee that any price, deal, or detail is accurate, complete, current, or available.

Always confirm details directly with the airline, hotel, operator, or other provider before you book or travel. You are responsible for your own travel decisions, including checking entry, visa, health, and safety requirements and any official travel advisories for your destination.

7. Sponsored Content and Affiliate Links

Some content on the Services is produced in partnership with destinations, tourism organizations, or brands, and some links and offers on the Services are affiliate links. We may receive compensation when content is sponsored or when you click a link or make a purchase through one. We aim to identify sponsored content clearly. Compensation does not mean we guarantee or are responsible for any partner’s products or services.

8. Third-Party Sites and Services

The Services may link to or embed third-party websites, apps, and content, including booking sites, payment processors, and social media and video platforms. We do not control and are not responsible for third-party sites, their content, products, services, or privacy practices. Your use of them is at your own risk and subject to their terms and policies.

9. The Chrome Extension

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the Extension on devices you control for your own non-commercial use. The Extension identifies accommodation search context, hotel details, and prices on supported pages you visit in order to show you comparable offers, as described in our Privacy Policy. The Extension may update automatically. You may uninstall it at any time. Your use of the Extension is also subject to the Chrome Web Store’s terms.

10. Ownership and License

The Services and their content, including text, itineraries, photos, videos, graphics, logos, software, and design, are owned by TripScout or licensed to us by creators and other third parties, and are protected by copyright, trademark, and other laws. TripScout, @hotel, athotel, and related names and logos are our trademarks. All rights not expressly granted are reserved.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to view the Services and share links to them for your own non-commercial use. You may not copy, reproduce, republish, distribute, modify, or create derivative works from content on the Services without our prior written permission.

11. Acceptable Use

You agree not to:

  • Scrape, crawl, harvest, or use automated means to access or collect content or data from the Services, except for search engines indexing public pages in line with our robots.txt
  • Use content from the Services to train, fine-tune, or build artificial intelligence or machine learning models or datasets
  • Frame or mirror the Services, or remove copyright, trademark, or attribution notices
  • Decompile, reverse engineer, or modify the Extension or any other software that is part of the Services, except as permitted by law
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Services or their systems
  • Use the Services in violation of any law or to infringe anyone’s rights
  • Misrepresent an affiliation with TripScout or its partners

12. Submissions and Feedback

If any feature of the Services lets you submit reviews, ratings, photos, or other content (“User Submitted Materials”), you are responsible for what you submit and confirm that you have the rights to share it. You grant TripScout a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, display, modify, and distribute your User Submitted Materials in connection with the Services and our business. You may not submit content that is unlawful, infringing, or misleading, and we may remove any User Submitted Materials at any time. User Submitted Materials posted in public areas are public, as described in our Privacy Policy.

If you send us ideas, suggestions, or other feedback, you grant us the right to use it without restriction or compensation to you.

13. Copyright Complaints

We respect the intellectual property rights of others. If you believe content on the Services infringes your copyright, send a notice to our designated agent that includes: your contact information; a description of the copyrighted work; the URL of the material you believe infringes; a statement that you have a good-faith belief the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature.

Designated agent: TripScout, Inc., 3906 Cherrywood Lane, Annandale, VA 22003, [email protected]. We may remove material in response to valid notices.

14. Disclaimer of Warranties

THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TRIPSCOUT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, OR FOR ANY LOSS ARISING FROM TRAVEL, BOOKINGS, OR THIRD-PARTY PRODUCTS OR SERVICES, ARISING OUT OF OR RELATED TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE BOOKING GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).

Some jurisdictions do not allow certain warranty exclusions or liability limits, so some of the above may not apply to you.

16. Indemnification

You agree to defend, indemnify, and hold harmless TripScout and its officers, directors, employees, and agents from any claims, damages, losses, and expenses, including reasonable attorneys’ fees, arising from your misuse of the Services, your User Submitted Materials, or your violation of these Terms or of anyone’s rights.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Services will be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction.

18. General

These Terms, our Privacy Policy, and any Booking Terms presented at checkout are the entire agreement between you and TripScout about the Services. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them without restriction, including in connection with a merger, acquisition, or sale of assets. Sections that by their nature should survive termination will survive.
